The Supreme Court of India has recognized prostitution as a profession. This means that sex workers will now enjoy the same rights and protections as other workers. For example, they will be able to unionize and negotiate better working conditions. The ruling will also help break down the stigma surrounding sex work. Of course, some feel that this ruling is a step too far. Critics argue that it could lead to an increase in human trafficking and exploitation. Only time will tell whether these fears are founded or not. But for now, sex workers can breathe a sigh of relief knowing that the law has finally recognized their profession.
The three-judge panel, which included Justices L Nageswara Rao, BR Gavai, and AS Bopanna, issued six directives to preserve the freedoms of sex laborers, noting, “Sex workers are subject to equal security under the legislation.” The authorities must abstain from intervening or taking any criminal activity when it is evident that the sex worker is an adult who is engaged with consent.
